Our General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between Gretzmeier, Nill & Mayer GbR, hereinafter referred to as “Barschule Freiburg”, with consumers (§ 13 BGB) that are concluded via our online shop. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

2. Contractual partner, customer service

2.1 Conclusion of contract

The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalog. By clicking on the order button, you place a binding order for the goods and services contained in the shopping cart. The order will be confirmed immediately after the order is sent. We can accept your order by sending an order confirmation by email or by delivering the goods within five days, unless you have chosen the payment method PayPal, Amazon Pay, credit card or instant bank transfer. In these cases, the contract is always concluded at the time the payment instruction is confirmed by the payment service provider. If you have chosen the invoice payment method, we will accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within two days.

2.2 Conclusion of the contract partially under the condition of being of legal age

For all product groups that contain products for which the purchaser is legally required to be of legal age, the purchase contract is only concluded subject to the purchaser being of legal age. By placing the order with the Barschule Freiburg, the buyer declares that he or she is of legal age at the time of the order. This applies in particular to ordering cocktail boxes as well as booking spirits tastings and participating in cocktail courses with alcoholic drinks.

3. Shipping costs

4. Payment

Payment is made in advance, cash on delivery, PayPal, Amazon Pay, credit card, invoice, direct debit/direct debit. Advance payment: If you choose the advance payment method, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment. Cash on delivery: If you choose the cash on delivery payment method, the product and delivery costs will be charged by the deliverer. Paypal: You pay the invoice amount via the online provider PayPal. You must be registered there or register first. Amazon Pay: You use your Amazon account for the payment process. After legitimizing yourself with your access data, you can confirm the payment order to us. You'll get more information during the ordering process. Invoice: When purchasing on account, you always receive the goods first and you have a payment period of 7 days. Direct debit/direct debit: If you choose the direct debit payment method, give us a direct debit authorization and your bank details and we will deliver the goods after the debit has been made. Cash payment for self-collection: You generally have the option of collecting the item in person by making an appointment at the Barschule Freiburg. Retention of title: For consumers, we reserve ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve ownership of the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.

You only have the right to offset if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

If you are in arrears with any payment obligations to us, all existing claims will become due immediately.

5. Transport damage

If goods are delivered with obvious transport damage, please report such errors to the delivery person as soon as possible and please contact us immediately. Failure to make a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or transport insurance company.
